HM Car Rentals
Terms and Conditions
Vehicle Owners
Owner terms effective October 7, 2026
1. Owner insurance
Vehicle owners are responsible for carrying and maintaining their own full coverage insurance for their vehicles. Owners must confirm with their insurer that their coverage permits vehicle rentals and applies to their rental activities. HM Car Rentals does not carry or provide insurance that covers owners’ vehicles.
2. Maintenance and repairs
Owners are responsible for all maintenance and repairs to their vehicles and for keeping their vehicles safe and roadworthy for each rental.
3. Company liability
To the extent permitted by applicable law, HM Car Rentals is not liable for loss of, theft of, or damage to an owner’s vehicle, or for the vehicle’s insurance, maintenance or repair costs. Nothing in these terms excludes liability that cannot legally be excluded.
4. Recommended vehicle protection
It is preferred and recommended, but not required, that owners install a kill switch and a vehicle tracker to protect against unforeseen circumstances. Any installation and use must be safe and lawful, including any required tracking disclosures or consent. Never activate a kill switch while a vehicle is moving or in a way that endangers anyone. These devices do not guarantee protection or replace insurance.
5. Owner discretion to decline renters
Owners may deny a rental request if the renter does not meet rental requirements or if, in the owner’s judgment, the renter is not capable of safely renting and operating their vehicle. This decision is at the vehicle owner’s discretion, subject to applicable law, including nondiscrimination requirements.
6. Acknowledgment
By checking the owner acceptance box during registration or before publishing a vehicle listing, you acknowledge that you have read, understand and agree to these Owner Terms and Conditions.
Vehicle Renters
Renter terms effective October 9, 2026
1. Renter liability insurance
The Renter acknowledges and agrees that they are fully responsible for obtaining and maintaining their own liability insurance for any and all injuries, damages, or losses arising from the operation of the vehicle, subject to applicable law.
2. Supplemental insurance and acknowledgment
HM Car Rentals intends to offer supplemental liability insurance only; vehicle owners remain responsible for their own full coverage insurance. Supplemental insurance is priced at an extra $20.00 per rental day. Purchases through HM Car Rentals are not yet available; the planned policy details are set out in section 3 below. No insurance is included in the rental payment or activated by selecting an option. Any future offering will be subject to the applicable policy terms, limits, exclusions, eligibility and price.
Before reserving, Drivers must acknowledge these Renter Terms and explicitly choose Purchase with Us, when available, or Deny Coverage. Declining supplemental coverage does not waive the Renter’s obligation to obtain and maintain their own liability insurance. HM Car Rentals does not assume responsibility for the Renter’s actions while operating the vehicle, except where responsibility is imposed by applicable law.
3. Supplemental Liability Insurance (LIS) — policy details
- For rentals in the U.S., LIS provides up to $300,000 of protection should third party bodily injury and third party property damage claims be made against you by people injured in an accident, inclusive of any applicable minimum underlying state statutory limits. LIS safeguards your insurance policy and/or your personal assets for the first $300,000 should such claims be made against you.
- LIS provides uninsured/underinsured motorist coverage up to $100,000 per occurrence, inclusive of any applicable minimum underlying state statutory limits, for combined third party bodily injury and/or third party property damage claims. For rentals commencing in California, no uninsured/underinsured motorist coverage will be provided with the purchase of LIS, and there is no coverage for an uninsured/underinsured motorist claim as a result of the negligence of the rental driver.
- You and authorized drivers are covered while driving the rental car within the United States and Canada, but only if the car is rented in the U.S.
- Where permitted by law, no liability protection is provided under the terms of the Rental Agreement from claims of injury by others against you resulting from an accident with the rental car. Where protection is provided, it is generally no more than the minimum limits required by individual state law.
- If purchased, LIS provides coverage before your personal policy for third party property damage claims, up to a limit of $300,000 per accident, inclusive of any applicable minimum underlying state statutory limits.
- LIS is third party liability coverage only, except as pertaining to uninsured/underinsured motorist coverage (if applicable). Except where required by law, LIS does not cover personal injury to you or any authorized operator of the rental car, or to your or their family members who are related by blood, marriage or adoption and reside in your or their household.
- Exclusions to this coverage include, without limitation: if LIS is not accepted at commencement of the rental or if you fail to pay the charges for LIS; if you permit the use of the car by anyone other than you or an authorized operator, or if you or an authorized driver otherwise violate the Rental Agreement, including but not limited to operating the car while legally intoxicated or under the influence of alcohol, drugs or other absorbed elements, for any purpose that could properly be charged as a crime, to tow or push anything, in a speed or racing contest or demonstration, to carry persons or property for hire, or to carry hazardous materials; and if the car or LIS coverage was obtained by fraud or misrepresentation.
- LIS limits may vary in certain states, and terms and conditions apply. The purchase of automobile rental liability insurance is not required as a condition of renting an automobile.
- You may not need the automobile rental liability insurance offered by HM Car Rentals; your personal automobile insurance policy may provide coverage for your liability while operating a rental vehicle. Because LIS may provide a duplication of coverage already provided by your personal policy, it is recommended that you check your policy or consult your insurance agent or insurer. In most cases, before any coverage by your own policy would be applied to a claim, the protection provided under the Rental Agreement and LIS, if accepted, would first have to be exhausted. Keep in mind that claims against your personal policy can often result in premium increases or even lead to cancellation.

4. Liability Disclaimer Under the Graves Amendment
In accordance with 49 U.S.C. § 30106 (Graves Amendment), to the extent the statute applies, the Rental Company is not liable solely by reason of vehicle ownership for harm to persons or property that results from the Renter’s use, operation, or possession of the vehicle during the rental period. This protection requires the owner to be engaged in the business of renting or leasing motor vehicles and does not apply to negligence or criminal wrongdoing by the owner or its affiliate. Applicable state financial responsibility and insurance requirements remain in effect.
The Renter agrees that all liability, including civil and financial responsibility for accidents, injuries, property damage, traffic violations, towing, claims, lawsuits, and all related costs arising from the Renter’s use of the vehicle, is solely the responsibility of the Renter to the extent permitted by applicable law. Nothing in these terms excludes liability that cannot legally be excluded or transfers responsibility for another party’s negligence or criminal wrongdoing.
